Welcome to Streamline. These are the guidelines, or "Terms", that govern your use of the Streamline website ("Site"). By accessing or using the Site, you agree to comply with these Terms as well as all relevant laws and regulations that apply to the Site. Streamline Sports Limited, including its affiliates and subsidiaries (collectively "Streamline Sports Limited"), reserves the right to modify these Terms at any time, with changes becoming effective immediately upon being posted on the Site. We encourage you to revisit this page periodically to stay informed of any updates. If you fail to adhere to these Terms of Use, Streamline may restrict your access to the Site, prevent future use, cancel any ticket orders, and/or take legal action as necessary.

1. Introduction

1.1 Overview

Streamline offers a variety of products, features, and services that are accessible through (a) the website getstreamline.org; (b) offline offerings such as RFID, entry management, sponsorship, marketing, and distribution services; and (c) mobile applications, webpages, APIs, and subdomains ("Applications"). Collectively, these are referred to as "Streamline Properties" or our "Services." These Terms apply to any Site(s) where they are posted; if other terms or agreements are posted instead, those will take precedence in case of conflict.

1.2 Definitions

Throughout these Terms, "Organiser" refers to event creators using our Services to plan and manage events that are presented on the Services. "Consumers" are those using our Services to obtain information about or attend events, or for any other purpose. Both Organisers and Consumers, along with third parties using our Services, are collectively referred to as "Users," "you," or "your."

"Streamline Sports," "Streamline," "we," "us," and "our" refer to Streamline Sports Limited, its subsidiaries, and their respective officers, directors, agents, partners, and employees.

1.3 Additional Agreements

If you are an Organiser offering events with paid tickets, you are also subject to Streamline's Vendor Refund Requirements. If you are a Consumer, our Purchase Policy applies to you. By agreeing to these Terms, you also confirm that you have read and understood our Privacy Policy and Cookies Policy, which apply to all Users. In some cases, we may provide services that are not specifically described in these Terms; unless otherwise stated in a separate signed agreement, these Terms will also apply to those services.

1.4 Binding Agreement

These Terms of Service, along with the documents referenced herein, constitute the complete "Terms" governing your use of Streamline' Services. These Terms form a legally binding agreement between you and Streamline, defining your rights and responsibilities when using our Services. By accessing or using any of our Services, you agree to comply with these Terms. If you do not agree, please refrain from using the Services. If you are using the Services on behalf of an entity, you confirm that you have the authority to bind that entity to these Terms, and "you" will refer to both you and the entity.

2. Streamline’ Services and Role

2.1 Our Offerings

Streamline provides an efficient platform for Users to create profiles, manage events, and promote them to potential attendees or browsers on our Services or other online platforms. Our Services facilitate online or onsite ticketing and registration, solicit donations, sell or reserve merchandise or accommodations related to events, and allow Consumers to contact Organisers or associate multiple swimmers. Payments processed through our platform are allocated to Organisers accordingly.

2.2 Our Role

Streamline is not the creator, organiser, or owner of the events listed on the Services unless otherwise stated in the event details. We provide the platform that allows Organisers to manage and promote their events. The Organiser is solely responsible for ensuring that their event pages comply with all applicable laws and accurately represent the goods and services offered. Consumers are responsible for selecting their payment method during checkout.

3. Privacy and Consumer Information

3.1 Privacy Commitment

Your personal information is important to us at Streamline. All data provided by Users or collected through third parties is handled in accordance with our Privacy Policy.

3.2 Organiser Obligations

As an Organiser, you agree to comply with all applicable laws and policies when collecting and handling information from Consumers.

4. Terms Termination

4.1 Duration

These Terms take effect as soon as you access our Services and remain in effect until terminated. Either you or Streamline may terminate this agreement as described below.

4.2 Termination by Streamline

We may terminate your access to the Services if you violate these Terms, misuse the Services, or if continued access would violate any laws or expose us to legal liability. We may also choose to discontinue or modify our Services at any time, and we will attempt to provide notice if such termination could materially affect you. However, Streamline will not be liable for any consequences resulting from the termination of your access.

4.3 Termination by You

You may terminate your use of the Services by deleting your account, or, if you do not have an account, by ceasing to use the Services. If there is a separate agreement governing your use of the Services, these Terms will apply once that agreement expires or is terminated.

4.4 Provisions That Survive

Certain provisions of these Terms, such as those relating to liability, indemnification, and intellectual property, will remain in effect even after termination.

Permitted Use

You are authorised to visit, view, and retain copies of pages on this Site for personal use only. You may not duplicate, download, modify, publish, or distribute material from this Site without prior written permission, except as necessary to review event information or make purchases for personal use. Deep-linking to the Site is prohibited unless explicitly authorised by Streamline. All content on the Site, including text, graphics, images, and other materials, is considered "Site Content." Any content you contribute is "Your Content." "An Event" refers to swimming meets, competitions, galas, or similar activities. Additional credits may be posted for content not owned by Streamline.

Disclaimers

Streamline does not guarantee that the Site will be error-free or uninterrupted. The Site and its Content are provided "as-is" and "as-available." We do not warrant that downloads will be free of viruses or other harmful components. All warranties, express or implied, including those of merchantability and fitness for a particular purpose, are disclaimed. Streamline is not liable for any damages arising from the use of the Site.

Streamline disclaims any responsibility for the actions or omissions of third-party users, advertisers, or sponsors. We are not responsible for the products, services, or actions of any venue, organiser, or third party referenced on the Site. Misconduct by users or third parties should be reported to us, and we may investigate and take appropriate action at our discretion.

Copyright Policy

We will terminate the access of users who unlawfully transmit copyrighted material without proper authorisation. Users must ensure that any content they upload does not infringe on the rights of others. Upon proper notification, we will terminate the access of users who engage in unlawful infringement.

Links and Search Results

The Site may automatically generate links to third-party websites. Streamline has no control over these sites and does not guarantee their content. We are not responsible for the accuracy, legality, or safety of content on third-party sites. By using the Site, you agree that Streamline is not liable for any damages or losses resulting from links to other sites.

Prohibited Content

The following is a non-exhaustive list of content prohibited on the Site:

Offline Conduct

Although we cannot monitor users' offline conduct, it is a violation of these Terms to use any information obtained from our services to harass, abuse, or harm others. Streamline reserves the right to terminate access to the Site or its services for any conduct that violates these Terms or applicable laws.

Access and Interference
